United States Second Circuit

US v. Chu, 12-3120

The district court did not err in concluding that defendant was not entitled to a sentence reduction for acceptance of responsibility pursuant to United States Sentencing Guidelines section 3E1.1, where: 1) the district court was well within its discretion in denying a reduction on the basis that defendant had attempted to smuggle drugs into a detention center after his plea but before his sentencing, and such conduct is inconsistent with accepting responsibility; and 2) defendant's sentence is otherwise procedurally and substantively reasonable.
