United States Second Circuit

Berlin v. Renaissance Rental Partners, LLC, 12-2213

Judgment for plaintiffs ruling that a single-floor condominium unit in a multistory building is a "lot," thus triggering the disclosure and reporting requirements of the Interstate Land Sales Full Disclosure Act, and awarding plaintiffs attorneys' fees, is affirmed, where: 1) the conclusion of the Consumer Financial Protection Bureau and the Department of Housing and Urban Development that the statutory term "lot" applies to condominiums is a reasonable interpretation of their own definition of the term "lot"; and 2) the district court did not err in awarding attorneys' fees to plaintiffs.
