John Wiley & Sons, Inc. v. Kirtsaeng, 09-4896
On remand from the U.S. Supreme Court, which held that the "first sale" doctrine provides a defense against a copyright infringement claim based on unauthorized resale "where, as here, copies are manufactured abroad with the permission of the copyright owner," the judgment of the district court holding the first sale doctrine inapplicable to copyrighted works manufactured abroad is therefore reversed and remanded.
