United States Second Circuit

US v. Lifshitz, 11-2078

When sentencing a defendant after revoking a term of supervised release, a district court may not sentence based on the defendant’s need for rehabilitation, however, the record is clear that the district court did not sentence defendant to further his rehabilitation, so the judgment sentencing defendant to a term of 24 months' imprisonment and 12 months' supervised release is affirmed.
