Molchatsky v. US, 11-2510

In class action alleging defendant US Securities and Exchange Commission negligently failed to adequately investigate Bernard Madoff despite numerous warnings, and in doing so violated federal statutes, regulations and internal polices, dismissal of the suit is affirmed, where the discretionary function exception to the Federal Tort Claims Act shield's the SEC's conduct from plaintiffs' claim.
