United States Second Circuit

Evans v. Fischer, 11-4418

The grant of defendant's petition for habeas corpus is reversed, where the district court erred because the decision of the state court's affirmance of defendant's conviction, finding any state evidentiary error harmless and defendant's trial fundamentally fair, was not contrary to or an unreasonable application of Supreme Court precedent, as required for a grant of habeas corpus.
