United States Second Circuit

US v. Barton, 12-1116

Denial of an Assistant Federal Defender's (AFD) motion to withdraw from representing defendant in an underlying criminal matter is reversed because District Court abused its discretion by forcing AFD to continue representation, where the defendant, having been informed of his right to counsel: 1) refused to recognize AFD as his attorney; 2) stated he did not wish to have appointed counsel; and 3) made no attempt to establish his financial eligibility for appointed counsel.
