Natural Resources Defense Council, Inc. v. US Food and Drug Admin., 11-422

In an action to compel the FDA to finalize its regulation of triclosan and triclocarban, two chemicals used in over-the-counter antiseptic antimicrobial soap, summary judgment to defendants is vacated where: 1) plaintiff has presented evidence of Article III standing sufficient to withstand summary judgment as to the regulation of triclosan; but 2) plaintiff presented insufficient evidence of members’ direct exposure to triclocarban to support standing.
