Judgment awarding damages against defendants pursuant to the Employee Retirement Income Security Act (ERISA) for breaching their duties as fiduciaries of an employee welfare benefits plan, is affirmed, where: 1) plaintiffs have standing; 2) plaintiffs' Underfunding Claim and EOC Suffolk Delinquency Claim are timely; 3) defendants are fiduciaries; and 4) defendants breached their fiduciary duties with respect to the Underfunding Claim and the EOC Suffolk Delinquency Claim.
