Judgment dismissing plaintiffs' class action claims under the Fair Labor Standards Act (FLSA), the Racketeer Influenced and Corrupt Organizations Act (RICO), and New York Labor Law (NYLL), is: 1) affirmed in part with regard to the dismissal of the FLSA, RICO, and NYLL overtime claims for failure to state a claim; and 2) vacated and remanded in part, where the district court did not explain why plaintiffs' NYLL gap time claims were dismissed with prejudice.
