Desardouin v. City of Rochester, 12-187

Summary judgment for defendants on plaintiff's claims of gender discrimination and retaliation is: 1) affirmed in part on the retaliation and state law claims, where defendant showed that its reason for dismissing plaintiff was legitimate, non-discriminatory because she admitted to secretly recording officials in violation of law and departmental policy; but 2) reversed and remanded in part on the hostile work environment claim where the male employee's comments were sufficiently offensive and pervasive to warrant a trial.
