Judgment of dismissal of plaintiff's claims brought under the Americans with Disabilities Act (ADA) for defendants' refusal to waive filing deadlines for filing for disability retirement benefits, failing to assist her in filing, and denial of retirement benefits is: 1) vacated and remanded in part on the claim against defendant New York State and Local Retirement System, where Title II of the ADA does, in some circumstances, require reasonable departures from standards established by state laws; and 2) affirmed in part on claim against defendant library-employer, where, based principally on the structure of the ADA, Title II does not apply to employment discrimination.
