Longman v. Wachovia Bank, N.A., 11-4225
In action for violations of the Fair Credit Reporting Act and common law defamation, summary judgment for defendant-bank is affirmed, where: 1) there is no private right of action for violations of section 1681s-2(a) of the FCRA; and 2) the district court did not abuse its discretion by preemptively denying leave to amend the complaint to plead a claim under section 1681s-2(b) in light of plaintiff's delay and the prejudice to defendant-bank.
