United States Second Circuit
Ment Bros. Iron Works Co. v. Interstate Fire & Casualty Co., 11-2596
In action for declaratory judgment where policyholder, a welding subcontractor, sought a declaration that its insurer was obligated to defend and indemnify it in suit for property damage alleged to have been caused by it during construction of a residential building, summary judgment for insurer is reversed, where: 1) the project was an apartment building as defined in the insurance policy when the damage occurred; and therefore 2) the policyholder was covered by the policy.
