United States Second Circuit
Gusler v. City of Long Beach, 11-4493
In plaintiff's civil rights suit against various city officials alleging he suffered retaliation for speaking out about issues involving his employer, defendants' appeal of the district court's denial of their dismissal motion raising a defense of qualified immunity is dismissed for lack of jurisdiction where the notice fails to comply with the requirement of Federal Rules of Appellate Procedure Rule 3(c)(1)(A) that the notice "specify the party or parties taking the appeal."
