US v. Gupta, 09-4738

In appeal from conviction for immigration fraud, judgment is vacated and remanded where, under the particular circumstances of this case, the district court's intentional exclusion of the public from the courtroom during the entirety of voir dire, without prior consideration of the factors identified in Waller v. Georgia, 467 U.S. 39, 48 (1984), violated defendant's Sixth Amendment right to a public trial.
