United States Second Circuit

VAM Check Cashing v. Federal Insurance Company, 11-2644

In breach of contract action for failure to pay claim submitted under a crime insurance policy, summary judgment granted in favor of plaintiff-insured is affirmed where the district court correctly ruled that: 1) the policy's definition of "robbery" is ambiguous; 2) the plaintiff-insured offered a reasonable interpretation of the policy permitting coverage; and 3) the defendant-insurer was therefore liable for the loss.
