US v. Harrison, 11-1240
In appeal from drug conviction entered pursuant to plea agreement whereby defendant agreed not to appeal provided sentence imposed was the mandatory minimum sentence of 120 months, judgment is affirmed, where: 1) defendant's waiver of appeal was made voluntarily, knowingly, and intelligently; and 2) the change in law caused by the subsequent interpretation of the Fair Sentencing Act in Dorsey v. United States, is not sufficient to upset a valid waiver of appeal.
