Coollick v. Hughes, 10-5248
In 1983 action against defendant Superintendent of Connecticut Technical High School System alleging deprivation of procedural due process rights when defendant eliminated plaintiff's guidance counselor position, the denial of defendant's Motion for Summary Judgment is reversed and remanded, where: 1) defendant's conduct did not violate plaintiff's rights because there is no due process violation where pre-deprivation notice is provided and deprivation issue can by fully remedied through the grievance procedures provided for in a collective bargaining agreement; and 2) defendant is entitled to qualified immunity.
