In re Air Cargo Shipping Servs. Antitrust Litig., 11-5464

In an action alleging a conspiracy by foreign airlines to fix prices in violation of state antitrust, consumer protection, and unfair competition laws, dismissal of the claims as expressly preempted by federal law is affirmed where: 1) the Federal Aviation Act expressly preempts state law claims "related to a price, route, or service of an air carrier;" and 2) the term "air carrier" in that provision applies to domestic and foreign air carriers alike.
