In bankruptcy action, judgment dismissing debtor-Lehman Bros.' appeal from bankruptcy court’s denial of its motion for leave to intervene in an adversary proceeding is vacated and remanded where, irrespective of the merits of the motion for leave to intervene, the bankruptcy court's order was a final and appealable order that should have been considered by the district court on the merits.
