United States Second Circuit
Giraldo v. Kessler, 11-2367
In a section 1983 suit, alleging that defendants' interrogation of plaintiff following the arrest of her boyfriend, former New York State Senator Hiram Moserrate, violated her civil rights, district court's denial of defendants' motion for absolute immunity is vacated and remanded where defendants' interview was an integral part of defendants' advocatory function as prosecutors protected by absolute immunity, even though questioning an important witness may accurately be described as investigative.
