United States Second Circuit
Ryan v. Nat'l Union Fire Ins. Co. of Pittsburgh PA., 10-4528
In an insurer's challenge to the district court's decision awarding plaintiffs consequential damages for the defendant's breach of its duty to defend them in a securities litigation, although the district court properly determined that defendant breached its duty to defend, because the question regarding the availability of consequential damages solely for breach of the duty to defend has not been decided under Connecticut law, this question is certified to the Supreme Court of Connecticut, as well as the question of whether consequential damages may include damages for harm to reputation and loss of income.
