United States Second Circuit

EM Ltd. v. Republic of Argentina, 11-4065

In bondholders' suit against the Republic of Argentina for defaulting on payments of its external debt, district court's order compelling two non-party banks to comply with subpoena duces tecum seeking information about Argentina's assets located outside the United States is affirmed, as because the district court ordered only discovery, and not the attachment of sovereign property, and because that discovery is directed at third-party banks, Argentina's sovereign immunity is not affected.
