Hecht v. United Collection Bureau, Inc., 11-1327
In a suit against a debt collector, claiming violation of the Fair Debt Collection Practices Act (FDCPA), district court's dismissal of the claim as precluded by a judgment in a prior class action, is reversed and remanded, as res judicata does not bar plaintiff's claim because she had a due process right to notice that was not satisfied by the single notice in USA Today.
