United States Second Circuit
Cage v. Comm'r of Soc. Sec., 09-4530
District court's judgment upholding the denial of petitioner's application for disability benefits in concluding that drug addiction or alcoholism (DDA) was a contributing factor material to the determination that she was disabled and therefore ineligible for benefits, is affirmed, as the ALJ did not err in denying benefits because SSI applicants bear the burden of proving that they would be disabled in the absence of DDA and substantial evidence supported the ALJ's finding that petitioner would not be disabled absent DDA.
