United States Second Circuit

Messier v. Bouchard Transp., 10-5181

In a seaman's suit against his former employer, a tugboat operator, seeking inter alia maintenance and cure after contracting lymphoma, district court's grant of defendant's motion for summary judgment is reversed and remanded, as because the seaman's illness indisputably occurred during his service, he is entitled to maintenance and cure regardless of when he began to show symptoms.
