United States Second Circuit

US v. Pica, 10-5026

Defendant's conviction for participating in a racketeering enterprise and illegal gambling is affirmed where: 1) there was sufficient evidence adduced at trial of defendant's knowing participation in the conspiracy to rob a victim to sustain the racketeering conviction; 2) defendant's challenge to the district court's empanelment of an anonymous jury is rejected as the district court acted well within its discretion when it determined, based on defendant's history of jury tampering and other factors, that the additional protection provided by jury anonymity was warranted; and 3) defendant's challenge to the substantive reasonableness of his sentence is without merit.
