In an appeal of pre-trial orders in a death penalty case, the District Court's exclusion of evidence that the government sought to offer in the punishment phase is: 1) affirmed in part as to the exclusion of evidence of two of the alleged six prior rapes; and 2) vacated in part as to the exclusion of evidence of the attempted obstruction of justice.
