Galiano v. Fidelity National Title Insurance Co., 10-4941

In a putative class action, alleging that title insurance company defendants sold title insurance at improperly inflated rates as a result of illegal kickbacks in violation of the anti-kickback provision of the Real Estate Settlement Procedures Act (RESPA), 12 U.S.C. section 2607(a), dismissal of the action is affirmed where the complaint did not allege factual content that would have allowed the district court to draw a plausible inference that defendants paid kickbacks for business referrals in violation of RESPA in connection with the title insurance policies purchased by plaintiffs.
