Broadcast Music, Inc. v. DMX, Inc., 10-3429
In a consolidated case involving two petitions requesting the court to set a "reasonable" rate pursuant to antitrust consent decrees, after music performing-rights organizations (PROs) ASCAP and BMI were unable to agree on licensing fees with DMX, a commercial music service provider, the District Court's judgment setting rates is affirmed where it did not set an unreasonable fee for PROs' licenses with DMX by incorporating the extent to which DMX relied on direct licenses.
