United States Second Circuit

US v. Wagner-Dano, 10-4593

A 78-month prison term for wire fraud is affirmed against contentions of procedural and substantive unfairness, where: 1) the district court did not commit plain error by allegedly inadequately considering the 18 USC section 3553(a) sentencing factors or by allegedly failing to rule on the defendant's objections to the presentence investigation report; and 2) the sentence was within the guidelines range, and there was nothing in the record to indicate that the district court imposed an unacceptably harsh sentence.
