Disability Advocates, Inc. v. New York Coalition for Quality Assisted Living, Inc., 10-235

In a suit brought by a private nonprofit organization contracted to provide services to New York State's protection and advocacy system under the Protection and Advocacy for Individuals with Mental Illness Act, alleging that various state agencies and officials violated the "integration mandate" of Title II of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act, the judgment and remedial order of the district court is vacated and the case dismissed for want of jurisdiction, where: 1) the plaintiff did not have the "indicia of membership" required of nonmembership organizations for associational standing; and 2) the intervention of the United States after the determination of liability but before the imposition of a remedy was insufficient to cure the jurisdictional defect.
