Louis Vuitton Malletier S.A. v. LY USA, Inc., 08-4483
In a suit alleging trademark counterfeiting and infringement, the judgment of the district court in favor of the plaintiff is affirmed, where: 1) the district court did not abuse its discretion in declining to stay the proceedings pending resolution of criminal prosecutions of the individual defendants; 2) an award of attorney's fees under the Lanham Act at 15 USC section 1117(a) may accompany an award of statutory damages pursuant to 15 USC section 1117(c); and 3) the district court did not abuse its discretion in awarding such fees or in setting their amount.
