Cuff v. Valley Central School District, 10-2282

In a suit under 42 USC section 1983 by parents of an elementary school student, alleging that his First Amendment rights were violated when he was suspended for six days after expressing a wish for violence to the school and teachers as part of a drawing exercise, the district court's grant of summary judgment to the defendants is affirmed, where the defendants could reasonably have concluded that the child's drawing would substantially disrupt the school environment.
