Hilton v. Wright, 10-135

In a suit under 42 USC section 1983, the Americans with Disabilities Act (ADA), and the Rehabilitation Act against the New York State Department of Correctional Services and its chief medical officer: 1) the district court's grant of summary judgment to the defendants on the plaintiff's claims for damages is vacated and the case remanded for the district court to address more fully the defendants' motion, where the district court did not adequately explain why it granted the defendants' motion; and 2) the part of the district court's order denying the plaintiff's application for reimbursement of out-of-pocket expenses is vacated and the issue remanded, where the district court misinterpreted the parties' settlement agreement with respect to the recovery of reasonable costs.
