Licci v. Lebanese Canadian Bank, SAL, 10-1306

In a case brought by Israeli residents who were allegedly injured by rockets fired by Lebanese terrorist organization Hizballah into northern Israel, alleging negligence against a New York bank that facilitated wire transfers on behalf of a Lebanese bank and an alleged Hizballah affiliate, the district court's dismissal of the claim for failure to state a claim is affirmed, where: 1) New York law and not Israeli law applied, because New York, not Israel, had the stronger interest in regulating the conduct of New York-based banks operating in New York; and 2) the plaintiffs conceded that their claim failed if New York law applied.
