Vega v. Walsh, 10-2540
The district court's denial of a petition for habeas corpus is affirmed, where: 1) evidence of the defendant's uncharged crimes and "Enforcer" tattoo was at least arguably relevant, and even assuming there was error in admitting it, the evidence was not so extremely unfair that its admission violated fundamental conceptions of justice; and 2) there was nothing unreasonable in the New York Appellate Division's conclusion that the testimony of a medical examiner about an autopsy she had not performed was not barred by the Confrontation Clause.
