United States Second Circuit

Levitt v. Brooks, 11-1233

In an attorney's fees dispute, the district court's grant of the attorney's motion to compel payment is affirmed, where: 1) ancillary jurisdiction existed over the fee dispute, and the district court did not abuse its discretion in exercising that jurisdiction; 2) the client waived his claims regarding the Federal Rules of Civil Procedure by not raising those issues in the district court; and 3) the client's due process and jury trial claims were without merit.
