United States Second Circuit

Collins v. Ercole, 10-2331

On petition for habeas corpus brought by a prisoner who had earlier brought several post-conviction motions in state court, the district court's dismissal of the petition as untimely is affirmed, where the state applications for post-conviction relief had not tolled the governing one-year statute of limitations for federal relief because they were not made with respect to the judgment challenged in federal court.
