US v. Steppello, 10-4527

In a prosecution alleging possession with intent to distribute cocaine in which the defendant sought to suppress cocaine seized from his person incident to his arrest, cocaine seized from his residence pursuant to a search warrant, and statements he made following his arrest, the district court's interlocutory orders granting motions to suppress are reversed, where the district court erred in determining that the police lacked probable cause to arrest and to search the residence.
