Ameriprise Financial Services, Inc. v. Beland, 10-3399
In an appeal from a judgment of the district court in favor of the defendant in plaintiff's arbitration complaint for breach of fiduciary duty and other related claims against financial services companies, judgment is affirmed in part and reversed in part where the court erred in directing a complete withdrawal on the grounds of release because plaintiffs' claims include "suitability" claims that were preserved by a carve-out clause in a previous class-settlement agreement between the parties.
