United States Second Circuit

US v. Roberts, 10-1230

In an appeal from a judgment of the district court convicting defendant of drug-related offenses, conviction and sentencing are affirmed over defendant's challenge on the grounds that: 1) the court erred in admitting his statements pursuant to a proffer because they were the product of economic coercion and his attorney's conduct did not trigger the proffer agreements waiver of Fed. R. Evid. 410, and 2) his sentence should not have been enhanced for abuse of a position of trust. Case remanded on the court's imposition of a $3,160,000 forfeiture.
