United States Second Circuit
Hill v. Curcione, 10-1320
In an appeal from a judgment of the district court dismissing a complaint against medical providers at a county jail for failure to state a claim and from summary judgment dismissing claims against defendant-corrections officers for lack of a triable issue of fact in a Section 1983 action alleging the application of excessive force and deliberate indifference to medical needs, judgment is affirmed with respect to the dismissal against one defendant and summary adjudication in favor of another, and reversed insofar as it erroneously dismissed plaintiff's complaint against a third defendant.
