United States Second Circuit
US v. Celaj, 10-2792
Conviction and sentencing of defendant on various gang-related charges including several Hobbs Act violations are upheld where stipulation that "marijuana is grown outside of the state of New York and travels in interstate and foreign commerce to arrive in the New York City area" alone, is sufficient to meet the required interstate jurisdictional element under the Hobbs Act.
