In an interlocutory appeal arising from a Section 1983 class-action brought by current and former female inmates of New York State prisons for injunctive and declaratory relief against sexual assault, abuse, and harassment by prison officials, judgment of the district court dismissing action is reversed where plaintiffs' claims for injunctive and declaratory relief are not moot because they are capable of repetition yet evade review, but undisturbed on plaintiffs' claims for damages where there is no appellate jurisdiction.
