United States Second Circuit

Williams v. Citigroup Inc., 10-538

In an action alleging violations of the Sherman Act, 15 U.S.C. Sections 1-2, and New York's Donnelly Act, N.Y. Gen. Bus. L. Section 340, judgment of the district court is affirmed with respect to dismissal of federal claims, but reversed on its order denying plaintiff's postjudgment motion seeking leave to replead, because the court erroneously applied a standard that overemphasized considerations of finality at the expense of the liberal amendment policy embodied in the Federal Rules of Civil Procedure.
