In a class-action complaint alleging breach of ERISA fiduciary duties by defendant's use of certain retained asset accounts through which it retained and invested for its own profit, life insurance proceeds due plaintiffs, 29 U.S.C. sections 1104(a) and1106(b)(1), judgment of the district court dismissing action is affirmed where complaint failed to state a claim for breach of an ERISA fiduciary duty.
