In a Section 1983 dispute alleging retaliatory termination for plaintiff's refusal to retract a truthful report and make false statements in order to conceal a colleague's use of excessive force, judgment of the district court is vacated in part where Garcetti and Weintraub do not preclude First Amendment protection for defendant's refusals to make the false statements.
