New York Civil Liberties Union v. New York City Transit Authority, 10-0372

In a dispute arising from an order enjoining the enforcement of defendant's policy requiring third parties to obtain the consent of those contesting notices of violation before defendant's Transit Adjudication Bureau in order to observe such hearings, judgment of the district court is affirmed because: 1) the First Amendment guarantees the public a presumptive right of access to the defendant's adjudicatory proceedings; and 2) defendant has not overcome that presumption.
